`COMES NOW the Plaintiff, by and through undersigned counsel, and serves this
`Notice of its Request that this Honorable Court take Judicial Notice pursuant to Florida
`Statutes §§ 90.201 and 90.202, requests that this Court to take , and in furtherance of that
`cause would show unto the Court as follows:
`1). This is an action seeking payment of benefits pursuant to a contract for
`automobile insurance which included collision and comprehensive coverage.
`Defendant has contumaciously refused to pay the subject invoice for the
`windshield replacement services rendered in the instant claim.
`2). Pursuant to Florida Evidence Code Section 90.201 and 90.202, the
`Plaintiff requests the Court take judicial notice of the following:
`a). Mitchell International Incorporated’s two trademarks: “NAGS” and
`“National Auto Glass Specifications.” Copies of these official
`governmental records can be found on the Trademark Electronic Search
`
`System of the United States Patent and Trademark Office at:

`3). Adequate notice to Defendant of Plaintiff’s intent to seek judicial notice
`of the above following is being given by virtue of this filing and this Court
`should permit the jury to be instructed as to these government records and
`related article.
`4). Defendant’s policy of insurance contains a limit of liability provision.
`Defendant’s interpretation of said policy relies in part on the “National Auto
`Glass Specifications” (“NAGS”). National Auto Glass Specifications is a
`trademark owned by Mitchell International, Inc. In 1991, Mitchel
`International, Inc. purchased National Auto Glass Specifications, Inc. The two
`companies merged, and Mitchel International, Inc. was the surviving entity.
`5). Mitchell International, Inc. provides customized price reports, data
`analytics, and price list catalogs to several of the nation’s top insurer’s, as well
`as select glass shops based on fee for service access. It is notable that this
`information is not available to the general public. Upon information and
`
`belief, Defendant has entered into a confidential agreement with Mitchell
`

`International, Inc. The terms of the agreement are unknown, but ostensibly
`include Defendant, or its third-party administrator, submitting information to
`Mitchell International, Inc that does not reflect the true market price of arm’s
`length glass sales.
`
`6). Mitchell International is in the business of providing data analytics and
`statistical reports to the insurance industry. Mitchell International, Inc does
`not provide reports or publish the rate payable at certain percentiles without a
`fee.
`
`7). Upon information and belief, Mitchell International, Inc claims its data
`regarding the subject motor vehicle is confidential and proprietary. It was
`provided by the insurers (retail purchase price) under a confidentiality
`agreement.
`
`8). Additionally, upon information and belief, Mitchell International, Inc
`currently uses the data obtained from over three hundred automobile insurers
`to create a data set. Mitchell International, Inc also utilizes geozips to
`determine pricing within a geographic area. The resulting data set is then
`scrubbed. High and low values are excluded from the data bases. The data is
`then sent through a proprietary algorithm to create a mathematical price. See
`Exhibit C. Mitchell’s benchmark price has never been intended for use as
`actual transaction prices. Instead, it has been about giving the auto glass and
`insurance industries an index of what auto glass is acquired for at a retail
`level. It is not a precise retail price but instead a range of prices as disclosed.
`

`n this month’s issue it’s all about
`
`the top auto glass companies,
`
`and they range from a billion-dol-
`lar retailer to those with a million
`in sales. This year, I took on the
`top auto glass retailers project,
`and it’s not one that is new to me.
`In fact, ’'ve overseen this massive
`undertaking since we started it five
`years ago. I always love to hear the
`stories of success, so I wanted to
`share one with you.
`
`AmeriPro Auto Glass in Jackson-
`ville, Fla., (see page 20) is posting
`phenomenal increases, and it is
`adding two more locations this
`year. Michael Franklin, administra-
`tive director, says one of the com-
`pany’s business models has helped
`propel AmeriPro from $1.5 million
`in sales in 2015 to $3.9 million in
`2016. I asked Franklin how they do
`it, and it turns out it has a lot to do
`with its dealer relationships.
`
`Dealer Services Division
`
`The company’s Dealer Services
`Division was launched in 2015 but
`really took off last year.
`
`“Our Dealer Services Division has
`proven itself to be a solid revenue
`generator,” says Franklin. “We have
`formed partnerships with 11 fran-
`chised car dealers that is beneficial
`to both parties and provides out-
`standing customer service to the
`dealerships’ customers.”
`
`Here’s how it works. The com-
`pany’s customer service repre-
`sentatives (CSR) work in the in-
`coming service lanes of these
`dealerships. The CSRs assist in
`tagging the cars, installing seat
`covers, etc., and making sure that
`the customer has been attended to
`within the first five minutes of their
`arrival.
`

`“They wear AmeriPro Auto Glass
`uniforms, and the customers are
`aware of who we are and what we
`do,” says Franklin. “They are allowed
`to inspect the windshield and any
`other glass related parts for dam-
`age. If they find damage, they must
`first approach the service writer re-
`sponsible for the vehicle and ask his
`or her permission to approach the
`customer about the damage. With
`the service writer’s permission, the
`CSR makes contact with the custom-
`er and in most cases, writes up a re-
`placement or repair. We do not offer
`ANY incentives to these customers.
`Commission is paid to the CSR at a
`flat rate. This is in addition to their
`hourly rate.”
`
`He adds that the customers love
`the program because they can get
`everything done at the dealer with-
`out having to first find a reputable
`auto glass shop.
`
`The company is also one of the
`few ready to take on vehicle cali-
`bration when the tools are avail-
`able, but that’s a story for another
`day. Oh, and it isn’t a member of
`any network. “We are the largest di-
`rect-bill company in Florida,” says
`Franklin. “We are not members of
`any networks. We set and get paid
`what we feel is fair and reasonable,
`not fixed pricing from TPAs or in-
`surance companies. We began di-
`rect-billing on December 18, 2013,
`and haven’t looked back since.”
`

`in most industries, and in
`the auto glass industry urethane
`manufacturers regularly issue and
`update them. The proper use of
`urethane is crucial to proper wind-
`shield installations.
`
`MSDSs are referenced throughout
`the ANSI/AGSC/AGRSS™ Standard.
`For example, the AGRSS Standard
`requires that “those engaged in au-
`tomotive glass replacement shall
`obtain and follow written compre-
`hensive and current application
`
`instructions from the retention sys-
`tems manufacturer or private label-
`er. These instructions shall include
`at least the proper use of the reten-
`tion system, storage specifications,
`minimum drive-away time charts
`containing temperature and humid-
`ity variables if applicable, and any
`special procedures required for ad-
`verse weather conditions.”
`
`So what type of information do
`urethane MSDSs provide? They in-
`clude details such as numbers to
`call in the event of an emergency
`while using the product; hazards
`
`identification, such as skin, eyes,
`inhalation, ingestion, etc. (and how
`each bodily system will affected
`by encountering the product); first
`aid measures to take if your eyes,
`skin, etc., come in contact with
`the product; how the product will
`react to fire hazards; precautions
`to take when handling and storing
`the product; how to protect your-
`self from the product; physical and
`chemical properties of the ure-
`thane; and ingredients.
