`INTRODUCTION AND BACKGROUND OF PARTIES

`A. Opposer Golden Pear Funding Opco, LLC
`

`Golden Pear Funding Opco LLC, a Delaware limited liability company
`
`(“Opposer”), having its principal place of business at 525 Washington Boulevard, Suite 2015,
`
`Jersey City, New Jersey 07310, believes that it will be damaged by registration of the trademark
`
`PICARE, Serial No. 98/387,528, and hereby opposes the same under Section 13 of the Lanham
`
`Act, 15 U.S.C. § 1063.
`

`Opposer is well-known for its pre-settlement and litigation funding services for
`
`personal injury plaintiffs.

`Opposer filed its intent to use application to register the PICARE trademark,
`
`Serial No. 97/386,905, on April 28, 2022, with the United States Patent and Trademark Office
`
`(“USPTO”). The mark application is pending in Class 36 for:
`
`Class 36: Financing services, namely, providing financing of
`medical expenses for pending litigation and structured settlements;
`Funding services, namely, providing medical funding to claimants
`or their attorneys through non-recourse advances during litigation
`in advance of settlement or trial; Arranging of non-recourse
`advances for medical funding in personal injury litigation; Funding
`services, namely, providing funding to claimants or their attorneys
`through non-recourse civil litigation advances in personal injury
`cases.

`A true and correct Trademark Status & Document Retrieval (“TSDR”) Status Report dated
`
`November 11, 2024, is attached as Exhibit “A” and incorporated by this reference. TBMP §
`
`704.03(b)(1)(A); TBMP § 704.05(a); TBMP § 317.

`Opposer has not yet proven use of its PICARE trademark in U.S. commerce, but
`
`will do so in due course. Accordingly, Opposer will have a constructive use date of November
`
`11, 2024, in the PICARE trademark in connection with the services in the application.
`
`B. Applicant Picare, CSP, a Puerto Rico Limited Liability Company
`

`Opposer is informed and believes that Applicant, Picare, CSP, a Puerto Rico
`
`limited liability company (“Applicant”), has an address of 954 Avenida Ponce De Leon, Suite
`
`205, San Juan, Puerto Rico 00907, as listed in Applicant’s trademark application for the mark
`
`opposed herein.
`

`On February 1, 2024, Applicant filed an intent-to-use application under Section
`
`1(b) with the United States Patent and Trademark Office (“USPTO”) seeking to obtain
`
`registration on the Principal Register for the PICARE trademark, Serial No. 98/387,528. The
`
`mark application is pending in Class 44 for:

`The PICARE trademark application was filed on an intent-to-use basis and no

`Opposer obtained a 30 day extension of time to oppose the PICARE trademark

`application. This Notice of Opposition is timely filed.

`II. GROUNDS FOR OPPOSITION - Likelihood of Confusion – 15 U.S.C. § 1052
`(d)

`Opposer repeats, realleges, and incorporates by reference, as though set forth here
`
`in full, paragraphs 1 through 10 above.

`The relevant evidentiary factors in this instance are the similarity of the marks, the
`
`relatedness of the goods and/or services, and the channels of trade and classes of purchasers for
`
`the goods and/or services. See, In re E.I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ
`
`563 (CCPA 1973); TBMP § 309.03(c)(2)(B).

`A. Opposer’s PICARE Trademark and Applicant’s PICARE Trademark are
`Identical
`
`Opposer repeats, realleges, and incorporates by reference, as though set forth here

`PICARE trademark it is likely to confuse consumers as to the source of Applicant’s services.

`B. The Services of Opposer and Applicant are Related and Opposer’s and
`Applicant’s Channels of Trade and Classes of Purchasers Are the Same
`
`
`

`Opposer’s PICARE trademark is pending in connection with financing services of
`
`medical expenses during litigation.
`

`

`
`Applicant’s PICARE trademark is pending for telemedicine services.
`
`The services recited in Applicant’s PICARE trademark application are closely
`
`related to and overlapping with those services with which Opposer plans to use its PICARE
`
`trademark.
`
`19.
`
`On information and belief, it is common for mark owners to use their marks in
`
`connection with both Opposer’s and Applicant’s services. For example:
`
`a. In connection with the trademark MARRICK, Marrick Medical offers “access to
`
`an expansive network of health care providers” and “provides medical funding for
`
`uninsured
`
`and
`
`underinsured
`
`accident
`
`victims.”

`The above-listed examples, attached as Exhibits “C” and “D” are merely samples
`
`that indicate that such services as those offered by Opposer and Applicant regularly emanate
`
`from the same source.
`
`21.
`
`Further, both Opposer and Applicant both attend the same trade shows, operate in
`
`the same channels of trade, and market to the same classes of purchasers, namely, personal injury
`
`plaintiffs and their attorneys.
`
`22.
`
`In fact, Opposer and Applicant both recently exhibited at the PIMCON, the
`
`“Personal Injury Mastermind Conference”; see, https://www.pimcon.org/; website accessed and
`
`screenshots taken December 4, 2024, attached as Exhibit “E” and incorporated by this reference.
`
`23.
`
`“It is sufficient that the respective goods [or services] are related in some manner,
`
`and/or that the conditions and activities surrounding the marketing of the goods [or services] are
`
`such that they would or could be encountered by the same persons under circumstances that
`
`could, because of the similarity of the marks, give rise to the mistaken belief that they originate
`
`from the same producer.” In re Jump Designs LLC, 80 USPQ2d 1370, 1374 (TTAB 2006),
`
`citing In re Melville Corp., 18 USPQ2d 1386 (TTAB 1991).

`The services need only be “related in some manner and/or if the circumstances
`
`surrounding their marketing are such that they could give rise to the mistaken belief that [the
`
`services] emanate from the same source.” Coach Servs. Inc. v. Triumph Learning LLC, 668 F.3d

`1356, 101 USPQ2d 1713, 1722 (Fed. Cir. 2012) (quoting 7-Eleven Inc. v. Wechsler, 83 USPQ2d

`1715, 1724 (TTAB 2007)).

`25. Moreover, “because the marks [here] are identical, the degree of similarity
`
`between the goods or services required for confusion to be likely declines.” DeVivo v. Ortiz,
`
`2020 USPQ2d 10153, at *11 (TTAB 2020) (citing Orange Bang, Inc. v. Olé Mexican Foods,
`
`Inc., 116 USPQ2d 1102, 1117 (TTAB 2015)).
`
`26.
`
`Because the services are highly related, the channels of trade for the services are
`
`presumed to be identical and it is presumed that the services would be marketed to the same
`
`classes of consumers. The services of the parties have no restrictions as to nature, type, channels
`
`of trade, or classes of purchasers and are “presumed to travel in the same channels of trade to the
`
`same class of purchasers.” In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908
`
`(Fed. Cir. 2012) (quoting Hewlett-Packard Co. v. Packard Press, Inc., 281 F.3d 1261, 1268, 62
`
`USPQ2d 1001, 1005 (Fed. Cir. 2002)). Thus, Applicant’s and Opposer’s services are related for
`
`likelihood of confusion purposes.
`
`C. Opposer Has Priority of Use of the PICARE Trademark
`
`
`
`27.
`
`Opposer repeats, realleges, and incorporates by reference, as though set forth here
`
`in full, paragraphs 1 through 26 above.
`

`
`Applicant’s PICARE trademark was filed April 28, 2022, almost two years prior
`
`to Applicant’s trademark filing for the identical PICARE trademark on February 1, 2024. Given
`
`Opposer’s expected constructive use date, Opposer has priority over Applicant for medical-
`
`related services. TMEP § 201.02; see, Syngenta Crop Protection Inc. v. Bio-Chek LLC, 90
`

`USPQ2d 1112, 1119 (TTAB 2009) (applicant may rely without further proof upon the filing date
`
`of its application as a “constructive use” date for purposes of priority).
`
`29.
`
`Because (1) Applicant’s proposed PICARE trademark is identical to Opposer’s
`
`PICARE trademark, (2) the services in Applicant’s application to register the PICARE mark are
`
`highly related and overlapping with the services identified in Opposer’s PICARE trademark
`
`application, (3) the respective channels of trade are related and overlapping, and (4) the services
`
`will be marketed to the same classes of consumers, Opposer, Golden Pear Funding Opco LLC,
`
`believes there is a high likelihood of confusion between the proposed PICARE trademark and
`
`Opposer’s PICARE trademark.
`
`30.
`
`Opposer will be damaged if Applicant obtains a registration for the PICARE
`
`trademark because Applicant will obtain statutory rights in that mark in violation and derogation
`
`of the prior rights of Opposer in its PICARE trademark.
`
`31.
`
`Applicant’s use of the PICARE mark for telemedicine services, as recited in
`
`Application Serial No. 98/387,528 is likely to cause confusion, mistake, or deception in that
`
`consumers and others are likely to believe that Applicant’s services are sponsored, authorized,
`
`approved by, associated or affiliated with, or in some way legitimately connected with Opposer,
`
`when they are not, with consequent injury to Opposer, the public, and the trade.
`
`32. When Applicant’s PICARE mark is used with telemedicine services it will cause
`
`consumers to mistakenly assume that Opposer is endorsing, attempting to promote, or
`
`encouraging the sale of Applicant’s services by permitting the proposed mark to be used with
`
`such services.

`Applicant’s proposed PICARE trademark is calculated or likely to cause
`
`irreparable loss, injury, and damage to Opposer’s business and to the goodwill as symbolized by

`its PICARE trademark.

`Registration of the mark shown in Application Serial No. 98/387,528 will result in
`
`damage to Opposer under the provisions of Section 2(d) of the U.S. Trademark Act, 15 U.S.C. §
`
`1052 (d), pursuant to the allegations stated above.
