`Mission Personal Injury Lawyers, P.C., a California corporation having its principal place
`of business at 2515 Camino Del Rio South, Suite 350, San Diego, California 92108, believes that
`it will be damaged by the registration of U.S. Trademark Application Serial No. 99/304,527 and
`hereby opposes the same.
`
`As grounds for opposition, Opposer Mission Personal Injury Lawyers, P.C. (“Opposer”)
`
`alleges as follows:
`
`Opposer’s MISSION Marks
`
`1. Opposer has used the MISSION Mark in association with legal services since at
`least as early as March 9, 2021.
`
`2. Opposer is the current owner of the MISSION PERSONAL INJURY LAWYERS
`Mark (collectively with the MISSION Mark, the “MISSION Marks”), which has been used in
`
`association with legal services since at least as early as March 9, 2021.
`

`3. Opposer’s use of the MISSION Marks continues to the present day and, as a result,
`Opposer owns common law trademark rights in the MISSION MARKS. In the process, Opposer
`has established substantial goodwill and valuable consumer recognition in the MISSION Marks.
`Specific, non-limiting examples of the MISSION Marks are included in the following paragraphs.
`
`4. Opposer owns U.S. Trademark Registration No. 6,676,009 for MISSION
`PERSONAL INJURY LAWYERS for use with legal services in International Class 45, which was
`registered on the Principal Register on March 22, 2022. True and correct copies of the
`corresponding Registration Certificate and the Trademark Status Document Retrieval (“TSDR”)
`page from the United States Patent and Trademark Office (“USPTQ”) website are attached hereto
`as Exhibit A.
`
`5. Opposer also owns U.S. Trademark Registration No. 8,098,939 for MISSION for
`use with legal services in International Class 45, which was registered on the Principal Register on
`January 13, 2026. True and correct copies of the corresponding Registration Certificate and the
`TSDR page from the USPTO website are attached hereto as Exhibit B.
`
`6. As aresult of Opposer’s long and extensive use of the MISSION Marks, they have
`
`become exclusively associated as designations of source for Opposer’s legal services.
`
`Applicant’s MISSIO LAW Mark
`
`7. Upon information and belief, Applicant Missio Law, P.A. (“Applicant”) is a
`Minnesota professional corporation with an address at 16617 Mayfield Drive, Eden Prairie,
`Minnesota 55347.
`
`8. Applicant seeks federal registration of the designation MISSIO LAW, which is
`
`confusingly similar to Opposer’s MISSION Marks.

`9. Applicant seeks federal registration of the MISSIO LAW designation in association
`with services (i.e., legal services) that are identical to Opposer’s services rendered under Opposer’s
`MISSION Marks (i.e., legal services).
`
`10. Specifically, on July 26, 2025, Applicant filed a Section 1(b) U.S. federal trademark
`application, accorded U.S. Trademark Application Serial No. 99/304,527 (“the ‘527 Application”),
`for MISSIO LAW in association with legal services in International Class 45. True and correct
`copies of the ‘527 Application and the TSDR page for the MISSIO LAW designation from the
`USPTO website are attached hereto as Exhibit C.
`
`11. The ‘527 Application for registration of MISSIO LAW (the “MISSIO LAW
`Application”) was filed well after Opposer: (a) commenced use of the MISSION Marks with its
`legal services; (b) obtained U.S. Trademark Registration No. 6,676,009 for MISSION
`PERSONAL INJURY LAWYERS; and (c) filed the U.S. federal trademark application for
`
`MISSION that ultimately registered as U.S. Trademark Registration No. 8,098,939.
`
`FIRST GROUND FOR OPPOSITION
`(Priority and Likelihood of Confusion)
`
`12. Opposer realleges the allegations contained in Paragraphs 1 through 11 of this
`Notice of Opposition as if fully set out herein.
`
`13. Opposer’s rights to and use of the MISSION Marks in association with legal
`services dates to at least March 9, 2021, with such use—and subsequent federal registrations—
`providing Opposer with the exclusive right to use the MISSION Marks, and prevent others from
`
`using confusingly similar marks, in association with similar services.
`

`14. The MISSION Marks were used in commerce in association with legal services for
`over four years before Applicant filed the MISSIO LAW Application in association with legal
`services.
`
`15. Applicant’s MISSIO LAW Application is similar in sight, sound, and/or meaning
`to: (a) Opposer’s MISSION Marks; and (b) Opposer’s U.S. federal trademark registrations for the
`MISSION Marks.
`
`16. Applicant’s MISSIO LAW Application is substantially identical, both in
`appearance and in its phonetic pronunciation, to Opposer’s MISSION Marks.
`
`17. The “MISSIO” portion of Applicant’s MISSIO LAW Application is similar in its
`phonetic pronunciation to the “MISSION” portion of Opposer’s MISSION Marks.
`
`18. As admitted by Applicant on July 26, 2025, in its initial filing for the MISSIO LAW
`Application, one of the English translations of “MISSIO” is “mission.”
`
`19. The “MISSIO” portion of Applicant’s MISSIO LAW Application is identical in
`meaning (i.e., “mission”) to the “MISSION” portion of Opposer’s MISSION Marks.
`
`20. Upon information and belief, the services for which Applicant seeks to register
`Applicant’s MISSIO LAW Application (i.e., legal services) are identical to Opposer’s services
`(i.e., legal services).
`
`21. Upon information and belief, Applicant intends to direct and sell its services under
`the confusingly similar MISSIO LAW designation to the same and/or overlapping consumers of
`Opposer’s services. In the process, Applicant is trading off of the goodwill that Opposer has
`engendered in promoting and selling its services under the MISSION Marks.
`
`22. Further, upon information and belief, Applicant and Opposer use, or will use, the
`
`same or overlapping channels of trade to target the same or overlapping prospective customers.
`

`On their face, the Identification of Services of the U.S. federal trademark registrations for
`Opposer’s MISSION Marks and Applicant’s MISSIO LAW Application are not limited as to
`consumers or channels of trade but, rather, cover all types of consumers and channels of trade.
`23. Opposer believes that it will be damaged by registration of the MISSIO LAW
`Application owned by Applicant, under Section 13 of the Lanham Act, on the grounds that the
`MISSIO LAW Application so resembles the MISSION Marks as to be likely, when used on or in
`connection with the services identified in the MISSIO LAW Application, to cause confusion,
`mistake, or to deceive consumers, with consequent injury to Opposer and to the public, in violation
`
`of Section 2(d) of the Lanham Act, 15 U.S.C. § 1052(d).
`
`WHEREFORE, Opposer requests that U.S. Trademark Application Serial No. 99/304,527 be
`rejected, that no registration be issued thereon to Applicant, that this opposition be sustained in
`
`favor of Opposer, and that such other appropriate and proper relief be entered.
