`Petitioner, The Law Offices of Joel J. Kofsky (“Petitioner”), hereby petitions the
`
`Trademark Trial and Appeal Board to cancel U.S. Trademark Registration No. 8,146,512

`(hereinafter the “512 Registration) as Petitioner believes that the mark in the ‘512
`Registration is confusingly similar to the mark in Petitioner’s preexisting U.S. Trademark
`Registration No. 4,620,744 ( hereinafter the ‘744 Registration) and that Petitioner has been
`and will continue to be damaged by the continued existence of the ‘512 Registration.
`
`By and through its undersigned counsel, Petitioner hereby requests that the ‘512
`Registration be cancelled in its entirety in accordance with Section 14 of the Lanham Act,
`15 U.S.C. § 1064(3).
`
`As grounds for this Petition to Cancel, Petitioner alleges, on knowledge as to its
`
`own acts, and otherwise on information and belief, as follows::
`
`1. Petitioner, The Law Offices of Joel J. Kofsky (hereinafter Petitioner or Kofsky),
`is a Pennsylvania Corporation having a place of business at 1500 John F. Kennedy
`
`Boulevard, Suite 550, Philadelphia, Pennsylvania 19102.
`
`2. On information and belief, Robert Vetchtein (hereinafter Registrant) is an
`individual having an address of 13 Corporate Plaza Dr., Ste 115, Newport, Beach,
`
`California 92660.
`
`3. Registrant filed U.S. Trademark Application No. 98/481,317 for “Shark Law
`Motorcycle Attorneys” (stylized) as an Intent-to-Use trademark application on April 3,
`
`2024, for “legal services” in International Class 45.
`
`4. The application matured into Trademark Registration No. 8,146,512 on
`February 17, 2026, with an alleged date of first use in commerce of March 28, 2024.
`5. Petitioner is now and has for many years been engaged in the provision of
`
`legal services in the United States.
`

`6. Petitioner is the owner of, and may rely in this proceeding on its valid and
`subsisting United States Trademark Registration No. 4,620,744 for “Law Shark” for
`“‘legal services” (the ‘744 Registration).
`
`7. Petitioner purchased the ‘744 Registration and all associated good will and
`other rights in and to the “Law Shark™ mark from Charles T. Conrad, P.S., Inc.
`(Conrad or Predecessor-in-Interest) on or about December 4, 2024.
`
`8. A copy of the electronic database records of the U.S. Patent and
`Trademark Office for the ‘744 registration is attached hereto as Exhibit A.6.
`
`9. Petitioner also is the owner of common law rights resulting from its and/or
`Conrad’s years of continuous and extensive use of the “Law Shark” mark in
`connection with legal services.
`
`10. The “Law Shark” mark has been used continuously by Kofsky and/or
`Conrad in connection with legal services since at least as early as March 21, 2014,
`which is about a decade prior to the date Registrant filed its application to register
`"Shark Law Motorcycle Attorneys"
`
`11. By virtue of extensive advertising and sales of legal services thereunder,
`the “Law Shark” trademark has become well and favorably known in the relevant
`trades and to the ultimate consumer market in the United States and has become and
`is a valuable symbol of Petitioner's business and the goodwill appurtenant thereto.
`Further, Petitioner's “Law Shark” trademark represents and conveys the reputation of
`Petitioner for high quality legal services.
`
`12. On information and belief, Registrant did not used its “Shark Law
`
`Motorcycle Attorneys” trademark in the United States until about a decade after the

`date that Petitioner and/or Conrad began using the “Law Shark” trademark in
`commerce.
`
`13. The services for which Registrant registered "Shark Law Motorcycle
`Attorneys" are identical to the services in connection with which Petitioner and/or
`Conrad has used and registered the “Law Shark” trademark, and, upon information
`and belief, said services of Registrant and those of Petitioner are intended to be sold
`
`to substantially the same class of customers.
`
`l. Likelihood of Confusion in Violation of 15 USC § 1052(d)
`
`14. Petitioner believes and therefore avers that the continuing existence of the
`. ‘512 Registration and use of the trademark "Shark Law Motorcycle Attorneys" by
`Registrant creates a likelihood of confusion with Petitioner's ‘744 Registration and
`common law rights to the “Law Shark” mark within the meaning of Section 2(d) of the
`Lanham Act, 15 U.S.C. § 1064(3), and will damage Petitioner for the following
`reasons, among others:
`a. Purchasers of Registrant's services and persons in the trade will
`be confused as to the source of origin of the services in connection
`with the "Shark Law Motorcycle Attorneys" mark; and
`b. Purchasers of Registrant's services and persons in the trade
`will mistakenly assume that such services are associated with,
`endorsed by, or in some way related to Petitioner in contravention of
`
`Section 2(d) of the Lanham Act, 15 USC § 1052(d).

`For the foregoing reasons, Petitioner believes and alleges that it has been, is
`being, and will continued to be, damaged by the ‘512 registration, and that the same
`should be cancelled in its entirety..

`8,146,512 be cancelled and stricken from the Principal Register.
