`Defendant Apple, Inc. (“Apple”) submits the following designations of discovery
`responses. The below table identifies Plaintiff Carbyne Biometrics, LLC’s (“Carbyne’s”)
`responses, or portions of responses, to Apple’s written discovery. Designated documents below
`include all prior versions, revisions, attachments, and supplements thereto.
`
`Apple believes that, pursuant to the Parties’ Joint Stipulation of Dismissal (Dkt. 154),
`portions of any designated discovery relating to U.S. Patent No. 10,929,512 (“the 512 Patent”) or
`induced infringement of third party password managers, which are no longer at issue, should be
`removed prior to submitting such responses into evidence.
`
`Apple reserves the right to modify its discovery designations for any reason, including
`upon the parties’ discussion of the issues and the Court’s ruling on motions and evidentiary issues.
`Additionally, Apple reserves the right to add discovery designations in this case hereafter. Apple
`
`also reserves the right to use any discovery at trial for impeachment purposes.
